Introduction
These Terms and Conditions (“Agreement”) establish a legally binding contract between Kaveesh Tours and you, the customer/traveller (“you”, “your”, or “traveller”), regarding the booking and participation in our travel and tour packages. This Agreement outlines the rights and responsibilities of both parties, ensuring a clear understanding of the terms under which travel services are provided.
By confirming a booking with Kaveesh Tours, you acknowledge that you have thoroughly read, understood, and agreed to all terms and conditions specified herein. This includes, but is not limited to, policies related to payment, cancellation, modifications, liability, and your responsibilities as a traveller. It is crucial that you familiarize yourself with these details prior to finalizing your booking to avoid any misunderstandings and ensure a seamless travel experience.
All claims, disputes, and issues related to any tour operated by Kaveesh Tours will be governed by Indian Law. Additionally, any legal matters will fall under the exclusive jurisdiction of the courts located in Kolkata, West Bengal, India.
1. TOUR RESERVATIONS
A booking shall be considered confirmed only upon the receipt of a fully completed booking form, accompanied by the required advance payment specified in the booking details. The individual making the booking must be at least 18 years old and is responsible for ensuring that all participants listed in the booking have acknowledged and accepted these Terms and Conditions.
Please note that all bookings are subject to availability and must be approved by Kaveesh Tours. It is advisable to check availability before proceeding with the booking process to avoid any inconvenience. Additionally, Kaveesh Tours reserves the right to refuse any booking that does not meet these criteria or is deemed inappropriate.
2. ITINERARY ACCURACY DISCLAIMER (BROCHURE & WEBSITE)
At Kaveesh Tours, we are committed to providing accurate and comprehensive information in our brochures, website, and promotional materials. However, please be aware that tour descriptions, itineraries, and pricing may be subject to change without prior notice due to unforeseen circumstances beyond our control, such as weather conditions, local regulations, or resource availability.
We strive to provide a seamless travel experience, but minor variations in the itinerary may occur in response to local conditions or operational reasons. We encourage our travellers to keep this in mind as they plan their journey with us. Additionally, please note that photographs and representations included in our materials are for illustrative purposes only and may not reflect the actual experiences or locations visited. Your understanding is appreciated as we work to deliver memorable and enriching travel adventures.
3. ITINERARY CHANGES & UPDATES
Kaveesh Tours retains the right to modify or adjust itineraries, travel routes, or other arrangements based on factors such as safety concerns, adverse weather conditions, or operational necessities. We are committed to making every effort to deliver the planned services as outlined in our itineraries. However, we must emphasize that no claims for compensation will be considered in the event of changes or omissions that arise due to unforeseen circumstances, such as natural disasters, government regulations, or any other unexpected events. Our primary focus remains the safety and well-being of our travellers, and we appreciate your understanding and cooperation in such situations.
4. TOUR PRICING INFORMATION
All tour prices are quoted in Indian Rupees (INR) and reflect the current exchange rates, transportation costs, accommodation rates, and applicable government taxes. These prices are based on a thorough assessment of market conditions at the time of booking. It’s important to note that prices are subject to revision without prior notice due to various factors such as currency fluctuations, alterations in government-imposed taxes, or adjustments in fuel surcharges. We recommend checking for the most up-to-date pricing prior to finalizing your travel plans to ensure you have the most accurate information.
5. PAYMENT TERMS & PROCESS
To confirm your booking with Kaveesh Tours, a non-refundable advance payment is required. The specific amount needed for this advance will be clearly stated at the time of booking. It is essential that the remaining balance is paid by the due date provided in your booking confirmation. Please be aware that failure to make the full payment by the specified deadline may result in the automatic cancellation of your booking, and no refund will be issued for the advance payment.
We offer several convenient payment methods for your transaction, including bank transfer, UPI, credit or debit card payments, and any other payment options that Kaveesh Tours may accept. Please ensure that all payments are completed promptly to secure your reservation and avoid any disruptions to your travel plans.
6. FLIGHT BOOKING & MODIFICATIONS
Airfare quotations are contingent upon availability at the precise moment of booking. Once tickets are issued, they will be governed by the specific fare rules and policies established by the airline. This includes but is not limited to conditions regarding changes to itineraries, the process for cancellations, and the potential for refunds. Any modifications or cancellations requested after ticket issuance will be subject to the airline's terms and conditions, which may include applicable service charges. Travellers are encouraged to review these rules carefully to fully understand their implications and avoid unexpected fees or penalties.
7. HOTEL & ACCOMMODATION DETAILS
Accommodation will be provided according to the specific tour package you select, ensuring that your lodging experience aligns with your expectations. The category of hotel—whether budget, deluxe, or luxury—will be clearly detailed in your itinerary to help you prepare for your stay. In the event that your chosen hotel becomes unavailable, we will arrange for a similar standard hotel to maintain the quality of your experience, although this change may occur without prior notice. Please note that check-in and check-out times will adhere to the established policies of the individual hotels, which may vary from location to location. We recommend reviewing these times in advance to facilitate a smooth arrival and departure experience.
8. TRANSPORTATION & SEATING ARRANGEMENTS
Transportation during tours will be meticulously arranged using well-maintained coaches or vehicles, tailored to accommodate the specific size of the group. To promote a fair and enjoyable experience for all participants, seat allocation may not be predetermined and could be rotated throughout the duration of the tour. This rotation is designed to foster interaction among group members and ensure everyone has the opportunity to sit in different areas. Additionally, the company reserves the right to substitute vehicles as needed, ensuring that all transportation meets safety standards and is equipped with necessary amenities for comfort, such as air conditioning and sufficient legroom.
9. MEAL PLANS & SPECIAL REQUESTS
Meals included in the tour will be clearly outlined in the itinerary, which will specify whether breakfast, lunch, or dinner is included for each day of the trip. To ensure a comfortable dining experience, any special dietary requests—such as vegetarian, vegan, gluten-free, or other specific needs—must be communicated in writing at the time of booking. Kaveesh Tours is committed to making reasonable efforts to accommodate these requests, but please note that while we strive to fulfil all dietary preferences, we cannot guarantee the availability of specific menu items. It is advisable to discuss any concerns with our team in advance to explore suitable options during your journey.
10. CURRENCY EXCHANGE & TRAVEL MONEY CARDS
Travellers must ensure strict compliance with the Reserve Bank of India (RBI) guidelines concerning the usage of foreign exchange. This includes understanding the permissible limits on the amount of foreign currency one can carry while travelling abroad. It is the traveller’s responsibility to adequately prepare by carrying sufficient local currency or preloaded travel cards to cover expenses that may not be included in the tour package, such as meals, transportation, shopping, or other personal expenditures. Additionally, it is advisable to check the current exchange rates and any applicable fees associated with currency conversion to ensure a smooth financial experience during your travels.
11. VISA, IMMIGRATION & REQUIRED TRAVEL DOCUMENTS
a) Passport
All travellers must ensure that they have a valid passport that is not only current but also has a minimum validity of six (6) months from the date of their planned return. This requirement is critical for entry into various countries, as many immigration authorities enforce this rule to prevent issues during international travel. It is advisable for travellers to check the expiration date of their passport well in advance and renew it if it's nearing expiration, as some countries may require additional time for the passport’s validity beyond the six-month mark.
b) Visa
Visa arrangements and associated fees are the sole responsibility of the traveller, except where explicitly stated otherwise in our policies. While Kaveesh Tours can provide valuable guidance and information regarding the visa application process, it is important to understand that we cannot be held accountable for any delays, complications, or rejections that may occur due to the policies and decisions of embassies or consulates. We encourage travellers to initiate their visa applications well in advance of their intended travel dates to allow for any unforeseen challenges.
c) Overseas Medical Insurance
All travellers are strongly advised to obtain comprehensive overseas medical insurance for the entire duration of their trip. This insurance should cover a wide range of potential health-related issues, including emergency medical treatment, hospitalization, and evacuation in the event of a serious illness or injury. Additionally, it is crucial to ensure that the policy includes coverage for trip cancellation, lost luggage, and any activities planned during the trip, such as adventure sports or excursions. By securing adequate medical insurance, travellers can protect themselves against unexpected expenses and ensure access to necessary medical care while abroad.
d) Immigration
Kaveesh Tours shall not be held liable for any traveller who is refused entry or exit by immigration authorities for any reason, including but not limited to issues related to visa validity, insufficient documentation, or non-compliance with local laws and regulations. It is the responsibility of each traveller to ensure that they possess all necessary travel documents and meet the entry requirements of their destination country. Kaveesh Tours strongly advises all travellers to check the latest immigration guidelines and regulations prior to their departure to avoid any potential disruptions to their travel plans.
12. ITINERARY AMENDMENTS & DEVIATIONS
Any requests for amendments or deviations to the original itinerary made after the tour has commenced will be evaluated based on current availability and may incur additional costs. These changes include, but are not limited to, alterations in accommodations, activities, or transportation arrangements. Approval of such modifications will be granted solely at the discretion of Kaveesh Tours, which retains the right to assess the feasibility and impact of the requested changes on the overall tour experience.
13. CANCELLATION
a) Cancellation of the Entire Tour by the Company
Kaveesh Tours reserves the right to cancel or postpone any scheduled tour in the event of insufficient participation, which occurs when the minimum number of participants required for a tour is not met. Additionally, if unforeseen circumstances arise, such as natural calamities (including but not limited to earthquakes, floods, or severe weather events), political unrest that poses a safety risk, or other unavoidable circumstances beyond our control, we may also need to adjust our tour plans.
In such situations, affected travellers will be promptly informed and will have the option to select an alternative tour that fits their schedule or receive a full refund of the tour price, minus a small administrative fee to cover processing costs. We prioritize our travellers' safety and satisfaction and strive to provide flexible solutions in the event of any disruptions to our planned itineraries.

b) Cancellation of Booking(s) by the Company with Cause
If a traveller fails to adhere to the established company policies, engages in inappropriate conduct, or causes disturbances that disrupt the overall harmony of the group, Kaveesh Tours reserves the right to cancel their booking immediately and without any refund. Such behaviours may include, but are not limited to, harassment of fellow travellers or staff, possession of illegal substances, or any actions that compromise the safety and comfort of others. The decision to cancel a booking is at the sole discretion of Kaveesh Tours, ensuring a positive experience for all participants.

c) Cancellation by the Traveller
If you decide to cancel your booking, we kindly ask that you inform us in writing at your earliest convenience. Please note that the cancellation fees will vary depending on how close the cancellation is to your scheduled departure date. Cancellations made well in advance may qualify for partial refunds, whereas cancellations made shortly before departure may result in higher charges.

e) Visa Delay or Rejection Resulting in Inability to Travel
In the event that your visa application is refused, delayed, or not issued in time, leading to your inability to attend the scheduled tour, we will consider your booking as cancelled. This cancellation will be effective from the date we receive official notification regarding the outcome of your visa application. Please note that applicable cancellation charges will apply based on our standard policy. For comprehensive information and assistance regarding visas, including potential processing times and requirements, please refer to our Visa Guidance section. It is highly recommended to apply for your visa well in advance to avoid any disruptions to your travel plans.

f) Visa-Related Cancellations near Departure Date
If a visa application is rejected or if there are delays that ultimately result in the cancellation of travel plans or the necessity to rebook flights immediately before the scheduled departure date, the traveller will be solely responsible for all related costs. This includes, but is not limited to, cancellation fees imposed by airlines or travel providers, rebooking charges for new flights, and any additional expenses such as accommodation changes or fees for rescheduling transportation. Travellers must be aware that these financial obligations are entirely their responsibility, and they should plan accordingly to mitigate potential risks associated with visa issues.

g) Cancellation Due to Non-Payment or Other Breach by the Traveller
If you do not pay the full cost of the tour by the specified deadline outlined in your booking confirmation, or if you violate any other terms and conditions related to your reservation, Kaveesh Tours reserves the right to cancel your booking without further notice. In the event of such a cancellation, the official cancellation date will be deemed to be the date when Kaveesh Tours issues a formal written notice of cancellation. Please be aware that cancellation fees will be applied according to the company's established policies, which may vary depending on the specific circumstances of the booking and the timing of the cancellation. We recommend reviewing our cancellation policy for detailed information on potential charges and deadlines.

h) Automatic Cancellation without Notice Due to Non-Payment
If the company does not issue a formal notice regarding payment obligations and your payment remains outstanding, or any default continues up until the day of your scheduled departure, your booking will be automatically considered cancelled on your behalf. In this scenario, the highest applicable cancellation charge will be enforced. By accepting these Terms and Conditions, you acknowledge and agree to the implications of this automatic cancellation clause, understanding that it is your responsibility to ensure all payments are made on time to avoid any penalties or loss of booking.
14. REFUNDS, CLAIMS & CUSTOMER COMPLAINTS
Refunds, if applicable, will be processed within 30 working days following the completion of the tour. It is important to note that no refunds will be issued for services that were not utilized, nor for voluntary non-participation in any segment of the tour, regardless of the circumstances.
In the event of any complaints or concerns regarding the tour, these must be submitted in writing within 7 days after the tour's conclusion. This timeframe is essential for us to address your issues effectively, as complaints raised after this period may not be considered or resolved. We appreciate your understanding and cooperation in adhering to these guidelines.
15. ADDITIONAL TRAVEL CONDITIONS
Travellers are required to adhere to the laws, customs, and cultural norms of all destinations they visit. This includes understanding local regulations, respecting traditional practices, and being mindful of social etiquette to ensure a harmonious experience. Kaveesh Tours will not be held responsible for any loss, damage, or theft of personal belongings during the trip. To safeguard against unforeseen circumstances, it is highly advisable for travellers to keep valuables secure, such as using anti-theft bags or locks, and to obtain comprehensive travel insurance that covers property loss, medical emergencies, and trip cancellations. Being well-prepared will enhance your travel experience and provide peace of mind.
16. HEALTH & SAFETY REQUIREMENTS (COVID-19 & OTHER PANDEMICS)
All travellers are required to strictly adhere to the health protocols, vaccination guidelines, and testing requirements established by both local and international authorities prior to embarking on their journeys. This includes obtaining the necessary vaccinations and carrying the required documentation, such as vaccination certificates and negative test results, which may vary based on destination.

It is essential for travellers to stay informed about the latest travel advisories and health regulations related to their destinations, as these can change frequently. Official government websites and global health organizations are reliable sources for this information.

Kaveesh Tours will not be held liable for any denial of travel, entry restrictions, quarantine expenses, or any additional costs incurred as a result of pandemic-related restrictions or last-minute changes in travel policies. Such circumstances can include sudden border closures, changes in testing requirements, or unexpected health mandates.

To safeguard against unforeseen circumstances and mitigate potential financial implications, we strongly recommend that all travellers consider purchasing comprehensive travel insurance. This insurance should cover a range of scenarios, including trip cancellations, medical emergencies abroad, and any costs associated with quarantine or medical care if necessary. Being well-prepared is crucial for a smooth and worry-free travel experience.
17. FORCE MAJEURE & UNFORESEEN CIRCUMSTANCES
Kaveesh Tours shall not be held liable for any loss, damage, or delays that result from circumstances beyond its reasonable control. These circumstances include, but are not limited to, natural disasters such as earthquakes, floods, hurricanes, and wildfires; acts of war or terrorism, including military conflicts or violent uprisings; labor strikes or work stoppages; political unrest, such as civil disorder or protests; public health crises like epidemics or pandemics; and governmental restrictions, including travel bans or sanctions imposed by local or international authorities. In such cases, Kaveesh Tours will take all reasonable steps to mitigate the impact on travellers but will not be responsible for any resultant inconveniences or expenses.
18. PRIVACY & DATA PROTECTION
Your personal information will be collected, processed, and stored securely in strict compliance with applicable data protection laws, including the General Data Protection Regulation (GDPR) and other relevant legislation. This information is essential for us to efficiently provide you with a range of travel services, such as booking accommodations, arranging transportation, and fulfilling your specific travel preferences.

Exceptions to this policy may occur only in instances where we are legally obligated to disclose information in accordance with law enforcement requests or other legal requirements.
